Terms of Use

The short version. Hollywood by Night is a free game for fun. There are no prizes and nothing to buy. We're fans, not the Golden Globes. Play fair, be decent in league names, and remember that scores are for bragging rights only.
1. Agreeing to these terms
These terms are an agreement between you and [LEGAL NAME OR COMPANY] ("we", "us"), which runs Hollywood by Night at hollywoodbynight.com (the "Service"). By creating an account or using the Service you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the Service.
2. An independent fan game
Hollywood by Night is an independent fan project. It is not affiliated with, sponsored by or endorsed by the Golden Globes, Dick Clark Productions, Penske Media, any studio, network or streaming service, or any nominee. Golden Globe® and other award names are trademarks of their respective owners and are used only to describe the real-world event that players predict. Film and series titles, posters and images belong to their owners.
3. How the game works
- Each season you pick contenders in every category and rank them with stars. You can change your picks until you submit your ballot or until ballots lock, whichever comes first. Once submitted or locked, picks can't be changed.
- Scoring follows the rules shown on the site at the time ballots lock: currently +1 for each pick that becomes an official nominee, and +3 when your top-starred pick wins. Only submitted ballots score.
- Results are based on the official announcements. We enter them by hand and may correct mistakes, which can change scores and rankings after they are first shown.
- Dates, categories and contenders depend on the real awards. If the event changes, is postponed or is cancelled, we may adjust, pause or end a season.
4. No prizes, no purchases
The Service is free. No purchase or payment is needed to play, and there are no prizes of any kind: scores and rankings are for fun only and have no cash or other value. It is not gambling or a sweepstakes. If you run a side bet or prize among your friends, that is entirely your own arrangement, not ours, and you are responsible for following the law where you live.
5. Your account
- You must be at least 13 years old (or the minimum age for consenting to online services where you live, if higher, unless a parent or guardian consents for you).
- One account per person. Give us accurate information and a real email address you control.
- Keep your password private. You are responsible for what happens under your account; tell us right away if you think someone else has used it.
- Your name and score are visible to the members of leagues you join. Anyone with a league's invite link can join it, so only share links with people you want in.
- You can stop using the Service at any time and ask us to delete your account.
6. Fair play
When using the Service you agree not to:
- use offensive, hateful, harassing, sexually explicit or misleading names for your profile or leagues, or impersonate someone else;
- create multiple accounts to gain an advantage in a league;
- scrape the Service, use bots or automated scripts, or overload our systems;
- probe, test or break our security, or access accounts or data that aren't yours;
- use the Service for anything illegal, or to send spam;
- copy, resell or commercially exploit the Service or its content.
We may remove names, reset scores, or suspend or close accounts that break these rules. Where reasonable, we'll tell you why.
7. Content and third-party services
- The Service, its design, code and branding belong to us. We give you a personal, non-exclusive, non-transferable licence to use it for your own non-commercial enjoyment.
- You keep any rights in the names you enter. You let us store and display them as needed to run the Service.
- Title information and images come from third-party sources, listed with their notices on our Credits page. Trailers are played through YouTube, whose own terms apply when you watch them. We don't guarantee that third-party information is accurate, complete or current.
- Links to other sites are provided for convenience. We aren't responsible for their content or practices.
8. Changes and availability
We may change, pause or stop the Service or any feature at any time, for example between awards seasons. We try to keep it running smoothly but don't promise it will always be available or error-free. We may update these terms. If a change is significant, we'll let you know by email or on the site before it applies. Continuing to use the Service after that means you accept the new terms.
9. Disclaimers and limitation of liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT ALLOWED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. BECAUSE THE SERVICE IS FREE, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO IT IS LIMITED TO US $50.
Some places don't allow these exclusions or limits, so some of them may not apply to you. Nothing in these terms limits rights you have as a consumer that can't be waived by law.
10. Indemnity
If you break these terms or the law while using the Service and that leads to a claim against us, you agree to cover our reasonable costs of dealing with it, to the extent the law allows.
11. Governing law and disputes
These terms are governed by the laws of the State of California and applicable US federal law, without regard to conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally. Any dispute that isn't resolved will be handled exclusively by the state or federal courts located in Los Angeles County, California, and you and we consent to their jurisdiction. Either of us may instead bring a qualifying claim in small claims court. If you live in the EU or UK, you can also rely on the mandatory consumer laws and courts of your country.
12. General
These terms and the Privacy Policy are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. If we don't enforce a term right away, we haven't waived it. You may not transfer your rights under these terms; we may transfer ours to a successor running the Service.
